This contribution addresses key elements of the special nature of trade in services from a legal perspective. The analysis is placed in the broader context of the external relations of the EC taking the multilateral and bilateral trade relations of the EC into account. The focus of the contribution is on trade in services at the international level. Apart from this external dimension of services liberalization, the scope and development of internal market law is also discussed in order to draw comparisons between external and internal law and to show the connection between the external and the internal dimension of services liberalization. The contribution discusses three main questions which are at the heart of the debates and controversies about trade in services in the external relations of the EC: What is “trade in services”? Who is in charge of trade in services within the EC? How are public services affected by agreements on trade in services? |
