Staatstheorie: Grundzüge ihrer rechtswissenschaftlichen Diskussion in der Bundesrepublik Deutschland

The paper analyses the course of legal theory of the state in Germany since the end of World War II. The notion of the state has been a central topic of German public law discourse since the end of the 19th century. It was used on different levels – from legal doctrine to more theoretical issues - to close the discipline from external irritation as well as to open it up for interdisciplinary input. The paper concludes with proposals for a contemporary legal theory of the state.
