| The paper analyses the course of legal theory of the state in Germany since the end of World War II. The notion of the state has been a central topic of German public law discourse since the end of the 19th century. It was used on different levels – from legal doctrine to more theoretical issues - to close the discipline from external irritation as well as to open it up for interdisciplinary input. The paper concludes with proposals for a contemporary legal theory of the state. |
