| The solution of global problems, such as those posed by the ubiquitous use of chemicals, is beyond the capability of the single state. At the same time, public international law is to cumbersome to bring about effective and legally binding solutions – despite efforts to modernize it. This paper describes how transnational acting bureaucracy networks set standards to tackle specific issues of chemical safety. These standards are not sources of public international law. However, they interact with the national legal orders. Because of this factual legal relevance they can be referred to as “transnational law”. In reference to the German experience with technical standards the paper addresses the legitimacy of transnational law. |
